These Terms govern your use of the Surplus apps (iOS, Android, web) and the surplus-app.com website. By creating an account or using Surplus, you agree to these Terms.
1) Accounts & eligibility
- You must be 16 or older and able to lawfully enter into a contract.
- Provide accurate information and keep your sign-in methods secure. You are responsible for activity under your account.
2) Service description
Surplus is a planning and forecasting tool: from the balances and plan you enter, it projects your household’s money day by day. It connects to no bank and moves no money. Features may evolve, and parts are offered as free or paid tiers.
Forecasts are estimates, not advice. Results depend on what you enter and on assumptions (e.g., dates, estimates for card spending). Surplus is not financial, tax or legal advice; you remain responsible for your financial decisions.
3) Households and shared data
- You can create households and invite others. Each member has a role (owner, editor, viewer) that determines what they can see and change.
- Every member can see the household’s data. Only invite people you want to see it. The owner can change roles and remove members.
- Content added by a member to a shared household is visible to all of its members, also after that member leaves.
- The household owner is responsible for the household. Only the owner can buy Surplus Plus for it, and the subscription stays with the person who pays for it (the payer), also if ownership later passes to another member.
- If the payer leaves the household or is removed, the household returns to the Free tier at once, without losing data. The subscription is not cancelled by this: it unlocks nothing until the payer attaches it to another household they own, and the payer cancels it in their store account (§4).
- If the payer deletes their Surplus account, the household also returns to the Free tier at once, without losing data. The subscription is not cancelled by this either: it no longer unlocks anything in Surplus and keeps renewing until the payer cancels it in their store account (§4).
4) Surplus Plus, purchases & billing
- Free and Plus. Surplus is free with limits; Surplus Plus unlocks additional features. One Plus subscription applies to the whole household, for all its members. Surplus Plus costs EUR 2.49 per month or EUR 19.99 per year, with a 14-day free trial. The price the store shows before you buy applies.
- Purchases are made through the Apple App Store or Google Play (the store is the seller for billing purposes); RevenueCat manages entitlements. There are no web purchases. Payment is charged to your store account.
- Free trial. If offered, it converts to a paid subscription at the end unless cancelled at least 24 hours before it ends (store rules).
- Renewal. Subscriptions renew automatically (monthly or annual) at the then-current price until cancelled.
- Cancellation is done in your store account settings and takes effect at the end of the current period; access continues until then. Deleting the app or your Surplus account does not cancel the subscription.
- Refunds and withdrawal. Subscriptions are sold by Apple or Google. Their terms govern cancellation and refunds, including any EU right of withdrawal. Your mandatory consumer rights are not affected.
- If Plus ends, you keep all your data; features beyond the Free tier are hidden or read-only, nothing is deleted.
- Price changes on paid plans are notified at least 14 days in advance and follow store rules.
5) Acceptable use
You agree not to:
- Use Surplus unlawfully or to infringe the rights of others;
- Upload or process illegal, infringing, harmful, or deceptive content;
- Probe, scan, or test vulnerability, or attempt to bypass security or access controls (including App Check);
- Reverse engineer, decompile, or derive source code except where permitted by law;
- Interfere with or disrupt the Service, including automated scraping or excessive load;
- Misuse support channels or send spam/abusive content.
We may suspend or terminate accounts that breach these Terms. Where lawful, we will notify you of the reason and how to appeal.
6) Your content & licences
You retain all rights to the content you enter or import. You grant us a limited, worldwide, non-exclusive licence to host, process, and display your content solely to provide the Service (including to the members of your households) and to comply with law.
We do not publish your content. There are no public-sharing features.
You are responsible for having the right to import the statements you upload.
7) Your data
- You can delete your account in the app. To get a copy of your data (JSON), or to delete a shared household as a whole, email us. See the Privacy Policy for details and retention.
- CSV and Excel statements are read on your device. Only normalised transactions are stored, for 24 months from import.
- PDF statement import is switched off and is not currently included in Surplus Plus. If we enable it, an uploaded PDF is parsed on our EU server and deleted after parsing (see the Privacy Policy).
8) Third-party services
Surplus relies on third parties (e.g., Apple, Google, Firebase/Google Cloud, RevenueCat, Resend). Your use of the app stores and sign-in providers is subject to their terms. We are not responsible for third-party services.
9) Changes to the Service
We may modify, suspend, or discontinue features with reasonable notice where materially adverse to paid users. For price or material feature changes on paid plans, we provide at least 14 days’ prior notice.
10) Termination
You may stop using Surplus and delete your account at any time. We may terminate or suspend access if you materially breach these Terms, engage in fraud/abuse, or as required by law.
Upon account closure, we delete your personal data per the Privacy Policy. We may retain minimal information as required by law (e.g., tax records).
11) Disclaimers
To the maximum extent permitted by law, the Service is provided “as is” and “as available.” We do not guarantee that Surplus will be uninterrupted or error-free, or that forecasts will be accurate or meet your requirements.
12) Limitation of liability
To the extent permitted by law:
- Indirect damages excluded. We are not liable for indirect, incidental, special, consequential or punitive damages.
- Liability cap. Our total liability arising out of or relating to the Service is limited to €50 or, if higher, the amount you paid for Surplus Plus in the 12 months before the event giving rise to liability.
Nothing in these Terms limits liability that cannot legally be limited (e.g., death or personal injury caused by negligence, fraud, or wilful misconduct).
13) Dispute resolution; governing law
Before formal action, each party agrees to first attempt to resolve the dispute through informal negotiation in good faith (email support@surplus-app.com). If unresolved, the dispute is subject to the laws of Luxembourg and the exclusive jurisdiction of the courts of Luxembourg City, without prejudice to mandatory consumer-protection rules of your country of residence.
14) Changes to these Terms
We may update these Terms. For material changes we will give reasonable notice (email, in-app or banner). Continued use after the effective date constitutes acceptance.
